New Delhi: Sabarimala temple case referred to larger Supreme Court bench of 7 judges. Supreme Court in 3:2 majority refers to 7-judge bench to consider earlier decision quashing the custom barring entry of women of 10-50 age group into Sabarimala Ayyappa temple.
Since the majority judgment was silent on any stay on earlier judgment, the SC’s earlier order throwing open gates of Sabarimala Ayyappa temple to women of all ages will remain in force till a 7-judge bench hears the matter afresh and gives its ruling.
Minority judgment by Justices R F Nariman and D at Chandrachud stuck to their earlier stand of quashing the custom which barred entry of women in 10-50 year age group. It said the issue of entry of women into mosques and agiyari could be considered by 7-judges.
Issue of entry of Muslim women in mosque, and entry of Parsi women in Agiyari, female genital mutilation of girl child in Dawoodi Bohra community are also to be considered by larger bench.
